Upcoming Supreme Court Ruling Will Impact Immigrants

In 2014, President Obama unveiled the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA). The policy, which would expand upon the existing Deferred Action for Childhood Arrivals, has been hotly contested by a number of states who claim that the policy would violate not only federal statutes, but the Constitution as well.

In February of 2016, 26 states led by Texas sued the federal government to prohibit this plan from being implemented. The plan was blocked with a preliminary injunction, and this injunction was upheld in November of last year. The Supreme Court has now agreed to hear the case, which could have a major impact on immigration policy in the years to come.

What Changes Would DAPA Bring?

The DAPA plan seeks to help more than 3.5 million undocumented immigrants living in the United States. This would grant deferred action status to qualifying immigrants, allowing them to work and live legally in the U.S. It is not the same as gaining legal status, but could make life significantly more comfortable for these individuals and their families.

To qualify for deferred action status under DAPA, individuals:

  • Must have lived in the U.S. since January 1, 2010 without any interruption
  • Must have been present in the U.S. when the program was announced, November 20, 2014
  • Need to be present in the country while applying for the program
  • Cannot have had lawful immigration status on November 20, 2014
  • Must have at least one child who is a lawful permanent resident or citizen
  • Cannot have a felony, significant misdemeanor, or three or more misdemeanor convictions
