H-1B Specialty Occupation Visa Attorneys
Experienced Immigration Lawyers
The H-1B visa authorizes foreign nationals who are professionals in their
field to come to the U.S. to work temporarily. It is often used to gain
professional work experience with the benefit of receiving a professional
salary for the work provided. H-1B visas fall under annual quotas, allowing
only a specific number of applications each year. The quotas do not apply
if you are a current H-1B holder wishing to extend your visa or change
employment.
If you need legal assistance when applying for an H-1B visa, Maney | Gordon

About the H-1B Visa
H-1B visas include a duration of increments of time that will not go beyond
six years in total. Your spouse and children are also allowed to accompany
you and stay for the duration of your employment under H-4 visas, but
they are not allowed to work. They are, however, allowed to attend school
or college. You may also work for more than one employer with an additional
H-1B visa that is in effect simultaneously.
In order to obtain an H-1B visa, you must meet a few requirements:
- You must have an educational degree or its equivalent in experience in
your specialty field
- A U.S. employer must have offered you employment in your specialty field
- If a license is required to work in your field, you must hold such a license
- Your employer must have labor certification for your employment under the
U.S. Department of Labor
Typical occupations under which an H-1B visa will fall include nursing,
engineering, academic professorships, research, computer science, and more.
