Executive Action Setback

On November 21, 2014 the President announced executive action which would have potentially provided work authorization for nearly five million undocumented immigrants. Shortly thereafter, 26 states led by Texas sued the federal government and a judge in Brownsville, TX granted the states an injunction against the President’s executive action.

Yesterday, a divided 5 th Circuit Court of Appeals denied the federal governments appeal for an emergency stay of the injunction, thereby further preventing the implementation of the President’s executive action benefits.

Notwithstanding the injunction, the underlying case remains pending in the U.S. district court in Brownsville, TX where it drags along in the early stages of discovery.
