U.S. Supreme Court Will Hear President's Executive Action Case

U.S. Supreme Court Will Hear President’s Executive Action Case

The immigration executive action announced by the President in November 2014, and blocked by a lawsuit filed by the State of Texas and 26 others, will be heard by the U.S. Supreme Court.

While the State of Texas fought a procedural battle whether the Supreme Court should hear the case, the justices announced their decision to hear the case after their private conference meeting last Friday.

The justices; however, potentially turned the case into a constitutional showdown because in addition to hearing Texas’ suit against the federal government, the justices are requiring the parties to address a constitutional issue which was never decided by the lower courts – specifically, whether the President’s decision to defer deportation of millions of undocumented immigrants constitutes an abdication of the President’s duties of chief executive.

Under the Supreme Court’s rules, the case will likely be heard in April and a decision rendered in June. This will no doubt inspire and revitalize the immigration debate and add fuel to an already heated presidential race. Stay tuned updates.
