ICE Reopening Administratively Closed Cases
Immigration & Customs Enforcement (ICE) Headquarters has confirmed that it is now re-calendaring certain cases that were previously administratively closed by way of exercise of prosecutorial discretion. This includes cases where there has been an arrest or conviction subsequent to the administrative closure. While ICE said that if there was an arrest or conviction prior to administrative closure, that should not trigger a motion to re-calendar and they are not seeking to re-calendar all of the cases that were administratively closed for PD; we cannot confirm what the actual policy is. This is a new disturbing and developing situation and we will keep our clients posted as we learn more.
