Immigration Information for Employers

In the United States, employers are required to verify certain documents and information about all potential employees as part of determining their eligibility for employment. When it comes to foreign nationals or non-U.S. citizens, there are additional verifications that must be made. First and foremost is the verification that the potential employee is legally authorized to work in the United States. Click here to read more information about I-9 employment eligibility verification.

An individual who is in the United States for the sole purpose of furthering their education would be on a student visa and be ineligible for full-time employment. Family visas are not proof of individuals' employment eligibility either. If an individual possesses a Green Card, he/she is eligible for employment, providing you, as the employer, has complied with all the employment verification requirements.

If you have questions about the eligibility of a potential employee, or if you wish to file a petition in order to allow a foreign national to obtain the required immigrant visa or non-immigrant visa that would allow them to work in the U.S., you need to contact a Tampa immigration lawyer at our firm immediately. Call (800) 708-4399.

Are You an Employer with Immigration-Related Questions?

There are situations that arise in companies where foreign labor may need to be hired, especially if qualified U.S. citizens are not available. In cases such as this, employers can petition for a foreign national to come to the United States to work either temporarily or permanently. This need most commonly presents itself when unique skills are required to perform certain tasks. It may be worth the effort to bring in an individual from a foreign country who already has the required technical skills, rather than to spend time and money training someone new.

It is essential that any employer, if they employ foreign nationals in their company, verifies the validity of proper immigration eligibility. Being neglectful or ignorant of immigration laws could result in legal complications for your company. That is why if you, as an employer, have immigration-related questions or are in need of immigration services, you must contact our firm at once.
