TPS for Haiti

The Department of Homeland Security (DHS) designated Haiti for Temporary Protected Status (TPS), starting August 3, 2021 through February 2, 2023. Additionally, Haitian beneficiaries who received TPS through the previous 2010 designation are also encouraged to reapply under this most recent designation. Eligibility for Haiti TPS

In 2010, Haiti suffered a major earthquake, which resulted in its original designation for TPS. The designation was extended many times until the Trump Administration announced that its TPS program would be terminated in 2019. However, it is still the subject of ongoing litigation in federal court and temporary extensions were granted to Haitian nationals through October 4, 2021.

Haiti received a new designation for TPS in 2021 due to increased unrest and violence this summer and broadened its requirements, making it possible for more Haitians to achieve eligibility for TPS. According to the USCIS, it is estimated that 155,000 Haitians will be eligible for TPS as a result of the new designation. If you are applying for TPS, you will have to undergo background and security checks to determine eligibility. Individuals who are 14 years of age or older must also undergo a biometrics (fingerprints) collection.

If you are eligible for Haitian TPS, you are encouraged to apply as soon as possible within the registration period. Do not hesitate to contact an experienced immigration attorney to assist you with the process and ensure it proceeds as efficiently as possible.
